According to the news, Mohammed Faizal, a Nationalist Congress Party leader and Member of Parliament from Lakshadweep, has filed a plea in the Supreme Court stating that he has not been reinstated back to the parliament despite the suspension of his conviction and sentence by the Kerala High Court. The Kerala High Court had suspended his conviction and sentence in a case of attempted murder, and Faizal and others challenged the trial court’s order in this regard. The Supreme Court has agreed to hear Faizal’s plea on Tuesday.
It seems that the case of Mohammed Faizal, the NCP leader and MP from Lakshadweep, is still ongoing. While his conviction and sentence have been suspended by the Kerala High Court, the UT Administration of Lakshadweep has challenged this order in the Supreme Court. The plea challenges the interim order passed by the High Court that suspended the conviction and sentence until the disposal of the criminal appeal. The matter will be heard by the Supreme Court on Tuesday.
The UT Administration of Lakshadweep has argued that the High Court’s decision to suspend Faizal’s conviction and sentence has the effect of reviving his status as an elected MP and is a violation of the Constitution and the Representation of the People Act. The plea stated that the suspension of the conviction and sentence of an elected MP by a court would have a cascading effect on the principles of the Constitution and the integrity of the parliamentary system. The Lakshadweep Administration has sought quashing of the High Court’s order suspending the conviction of Faizal and others in the murder case.
